DWI Trial Phase 2: Advanced Training for Judges
What is the purpose of this exercise and how does it differ from JEC's initial
on-line DWI training exercise?
This exercise is designed to present common legal, evidentiary and
sentencing issues which judges face in DWI trials. Phase I of JEC's DWI
on-line training, "DWI: State v. Jackal," contains video clips of a simulated DWI trial and
a series of questions that replicate issues, arguments and decisions judges face in DWI
trials. This second phase of DWI training also presents questions and possible answers on DWI-related
issues, but focuses more on complex issues and does not use video.
In addition, other DWI-related information is provided to further a judge's
understanding of DWI stops, arrest, chemical testing, and the admissibility
of evidence.
What DWI topics are covered in this exercise?
This training covers five major topics in DWI cases: initial stop
of the driver; field sobriety testing (FSTs), chemical testing (breath and blood testing)
of the driver following arrest, evidentiary issues, and sentencing. These topics contain subtopics with
factual scenarios, questions and multiple choice answers. Explanatory feedback is provided for each of the
possible answers.
What judges should take advantage of this exercise and why?
This exercise is designed
for judges in New Mexico. It gives judges the opportunity to
consider and respond to issues they face in DWI
trials. The feedback to the answers contains references to
applicable statutory and case law, plus additional DWI-relevant
information is provided.
Does this exercise qualify for continuing education credit? Completion of this
exercise
qualifies for three credit hours of Continuing Judicial Education (CJE)
or Continuing Legal Education (CLE). To obtain this credit, you must work through
the entire training and answer all of the questions. Your signature on the CJE/CLE Self-Reporting
Form certifies that you completed these requirements. Partial credit wil not be
given. The form is available on the final screen of the course.
How to Proceed
Register by clicking on the Registration link in the yellow box at the
right. Once you have logged in, the course can be done in order from start to
finish, or you can move about the pages in a random order. The course is
complete when you have visited all of the pages.
